Abstract

When patients are harmed by things such as unforeseen adverse reactions or disproportionate risks after making normal, reasonable use of a medicinal product, the product is defective. This commentary focuses on examining two recently given rulings whose core issue is whether a medicinal product for alleviating the symptoms of menopause should be considered defective. The authors therefore propose to analyse liability for damages caused by defective medicinal products, in particular, when a product can be regarded as defective, what damages can be sought and how that can be done.
