Abstract

The new regulation on development agreements, laid out under Act 8/2007 of 28 May on land and echoed in recent regional legislation as well, declares development agreements null and void if they impose obligations and commitments that step beyond the legal obligations and commitments. Thus, the regulation affects registrar scrutiny of such agreements and the acts stemming from such agreements, whereas the regulation forces registrars to refuse to register the stipulations of such agreements, as registrars hold ultimate responsibility for preventing the consummation of illegal acts of this nature.
