LA REFORMA DE LA LEGISLACIÓN CONCURSAL ITALIANA.

Abstract

Legislative Decree number 5 of 9 January 2006 on the organic reform of the discipline for bankruptcy procedures has deeply modified the Legge Fallimentare of 1942. The reform, which went into force in July 2006, has accommodated the Legge Fallimentare to the rulings of the Corte Costituzionale and to the new structure of the civil process and company law, and it has simplified and shortened the procedure's deadlines. It has been adjusted to Regulation 1346/2000 of 29 May on insolvency procedures and has eliminated obsolete institutions.
