Abstract

In this paper we endeavour to analyse the preferred rights of purchase granted to tenants under the Urban Leasing Act, whose purpose is fundamentally to protect the legal position of the tenant. We state the requirements for exercising prospective and retrospective rights of first refusal, highlighting the registration-related aspects and interpretation in case-law by both the Supreme Court and the Directorate- General of Registries and Notarial Affairs through the years.
