In this paper we have analysed the mortis causa assumption of the legal position of tenancy as regulated in article 16 of the Urban Leasing Act, by whose virtue a subrogee assumes the rights and obligations of a deceased tenant. We list the persons who hold a right of subrogation, the established order of priority, the requirements for subrogation to take place and the effects stemming from subrogation.
