Abstract

Constitutional acknowledgement of the fundamental rights (inviolability of one's domicile, privacy, etc.) with strengthened legal protection has set off a trend in established legal thought and case law where seriously harmful immissions that affect the person in connection with the person's seat or domicile are regarded as unconstitutional attacks or offences against the right to privacy, because the person is disturbed by said environmental interruptions (e.g. noise, harmful emanations), which seriously hamper the person's normal enjoyment of his or her domicile.
