Abstract

In Spanish Law, no rule recognizes legal personality to the condominum. However, it is raised whether such recognition would facilitate the management of this type of communities. The specific cases that may be problematic have been specifically regulated: the performance of these communities in judicial procedures, registrations in the Property Registry, the execution of contracts that are related to the community. However, this issue arises again in relation to the access of these communities to financing to carry out works of conservation, rehabilitation and improvement of the accessibility of buildings, an issue that,
together with those previously referred to, is addressed in this study. In short, it is about arguing and discussing whether it is convenient or necessary to recognize legal personality to communities of owners.
