Legal personality of the communities of owners under the horizontal property regime and the registration of rights in their favour in the land registry: «13 Rue del Percebe»

Abstract

The communities of property owners within the legal framework of the Commonhold Act lack legal personality. The absence, along with the Paramount importance which define this institution in our society, causes the appearance of numerous problems in the sphere of mass market consumer transactions. The inability to register rights in the Land Registry related to the abovenamed communities is regarded as one of the greatest problems of the system. The Government is facing a wide range of conflicts which require its attention and prompt solution to ensure a high degree of security and dynamism.
