Abstract

This article deals with the controversy created by the promulgation by the Criminal Chamber of the Supreme Court of Judgment 607/2020 of November 13 and the declaration therein, that the civil liability derived from a final criminal conviction does not prescribe until the complete satisfaction of the civil obligation. In this sense, the Supreme Court has prioritized the complete reparation of the victim and has assessed the complexities that exist in the criminal process, in order to not apply the institute of extinctive prescription.
