Agreements for the establishment of prohibitions in the horizontal property(condominium) statutes

Abstract

The statutes of a building in horizontal property constitute the main operative source in the regulation of horizontal property, and are the norms that govern its organization, structure and operation. These statutes may contain, consequently, prohibitions on different issues that concern it: on use, destination of the thing, activities that can be carried out ... This article analyzes the majority regime necessary to be able to incorporate a new prohibition in the statutes of a horizontal property, the requirements that the jurisprudence has established for it, its casuistry and the practical difficulties that said procedure has encountered in practice.
