The application of analogy in special laws

Abstract

This article analyzes the application of the analogy in case of tspecial laws. The general rule in this matter is that special laws can only be applied analogously inside its application ambience. Nevertheless, this rule is not absolute since sometimes it is not possible to apply the analogy between institutions of the same law, in addition, there are cases where the analogueue application of a special standard to another special standard or to an alleged lack of regulation is permitted, such as atypical contracts.
