Abstract

Once the active legitimation of the acquired company has been accepted for the claim for damages based on the contractual stipulation in favour of a third party, it will be necessary to determine, where appropriate, if a possible arbitration agreement inserted in the company sale contract signed by buyer and seller also affects to the acquired company.
