Abstract

The duty of conservation of immovable cultural properties, has traditionally been considered a pivotal element within historical heritage regulation and land use and zoning law. The consequences of this duty to its owner or rights´ holder translates into an additional economic burden that, in certain cases, should be subsidized by the Public Administration, due to a singular linkage of the properties. To that extent, the Land Register´s role will be crucial in order to legally protect owners and potential third-party acquirers, conserving not only the property but also ensuring compliance of all remaining rights and obligations legally recognized.
