Abstract

This academic article deals with extracontractual civil liability derived from bullying. The article delves into the different extracontractual liability systems that are applicable to bullying cases. In order to this objective, the article analyses profusely the two most frequent extracontractual liability systems in bullying cases: general extracontractual civil liability and civil liability derived from a criminal offence. In each of them, the article studies the liability of minors that commit bullying (civil liability arising from an own act) the liability of the parents of that minors and the liability of the owners of the schools where bullying is committed (civil liability for damages caused by others). Through this research, the article will elucidate if this variety of systems is advisable or if, on the contrary, it will be recommendable to unify all of them into a single extracontractual civil liability system.
