Abstract

Civil Lawsuit originating from criminal activity is a fair consequence of crimes that cause damages. Victims have the right to get a whole reparation. Although it’s true that pain and suffering reparation is more like a kind of compensation, it must be just as much comprehensive, sufficient, suitable and proportional. Sentences that judge gender-based violence are not granting appropriate compensation for pain and suffering damages, considering the grief endured, nor assessing specifically the pain suffered during years of mistreatment. It becomes a new way of victimizing women.
