Abstract

Actually the real estate registries have three important challenges: their modernization, to give a satisfactory public service and to generate legal security to real estate business. Modernize real estate registries, it shouldn’t be understood only to computerizing them, it’s much more than that, although the undoubted success of computing is recognized to optimize the registry service. It is important that the computerization includes the recordable document, registration request, the registration and the issuance of certificates. To give an excellent service require to pay attention to the user, who is the protagonist of the registry service. The contribution of the registry function to legal security in real estate traffic is possible regardless of the type of registration and the legal effects that each legal system assigns to the registration. The registration institutes of the Indirect Priority (in those countries where their notarial system has it) and the unbroken chain of juridical acts about real estate in the registry, the relationship between Cadastre and real estate registries, and a notary who do a correct juridical analyze, are the most important values to generate legal security. The registrar can generate this legal security alone or with other legal operators, depending of the law of each country.
