Abstract

The  Registrar   of  the  property  has  a  double   official  and  profes- sional  status. However, he is only  subject to  liability  for errors committed in  the performance of  his  qualifying function,  where  he  acts  as  a professional. It  can not  be  forgotten that  the  qualifying function  of  the  registrar  is  one  of  the  sup- ports  of  the  public   registry,  since  those  rights  that  the  registrar  registers  —after its  positive qualification— are under  the  safeguard of the  Court  and  are considered true  (Article  38  LH).  Then,  it  is normal that  if the  Registrar  entered  a right that  should not,  or vice  versa,  denied  the  registration to  another, this  would be a  detriment  to  the  owner   and  the  liability   of  the  Registrar   starts.   We  analyze in this paper, the liability  of the Registrar,  as an independent and autonomous professional of the  Law.
