Abstract

The coordination system between the Land Registry and the Cadastre in Spain now requires, for its progressive development, the registration of the cadastral graphical representations (CGRs) within the parent properties subdivided under the horizontal property regime. This requirement arises due to its significant practical implications, as it affects a large number of urban cadastral parcels and an even greater number of registered properties.

Following the Joint Resolution of 7 October 2020, the two competent authorities—the Directorate General for the Cadastre and the Directorate General for Legal Certainty and Public Faith—established the framework for such coordination, and since 2023, a cadastral service has been implemented to support its application in day-to-day practice.

It is the registered holders of ownership or of real rights over each independent unit, or their authorised representatives and/or the communities of property owners, who are legally entitled to request such registration. Moreover, it is within the powers of the Land Registrars to promote and implement this process.

The issue at stake is whether, nearly five years after the aforementioned Joint Resolution, it is now appropriate to issue a new resolution to enhance its implementation and to clarify the rules concerning the standing required to request such registration.
