Abstract

The civil societies depart from the historical tradition from that: once expired one of the partners becomes extinct, except agreement to the contrary. Our civil code regulates two suppositions of continuity: the agreement called of continuity of the surviving partners, and the agreement of continuity of the inheritors of the deceased partner. Of the reading of the article 1696 of the civil code there is deduced the possibility that a partner could transmit his condition of partner to a third party across a transfer of contract.
