Abstract

Disposal prohibitions as proprietary limitations that prevent effective transfer of ownership of a property, should be reflected in the registration folio of said property to be effective against potential third party purchasers. While only registration bans imposed on business have gratuitously allowed under art. 26 and 27 LH, authentic bans have real character, distinguishing them from the obligations of not having, in any case prevent the transfer of ownership of the property to the purchaser and he argued noncompliance with a mere compensation for the seller, but to recover property for whom imposed. His concept, character and efficiency, try to analyze these lines, in the light of the jurisprudence of the DGRN.
