Abstract

The existence of a certain causal nexus between a determined fact or activity and the damage have been elevated like an inescapable requirement for the birth of the civil responsibility, to the margin of which it is the imputation title that operates. However, the irruption of the systems of objective responsibility in second half of century XIX and its consolidation to long it of century XX has generated the necessity to review the traditional concepts of the civil responsibility, among them, the one of the causal relation: no longer it will be always indispensable, because it will be enough to generate responsibility that the damage has taken place within the framework of application of a special norm, has been developed fruit of a concrete activity, or, that exists a relation of material causality between the damage whose repair demand and the activity of the person to whom calls to each other.
